Banks are seeking personal guarantees from promoters for extra loan security when lending to companies. In the Subhash Chandra case, the situation got tricky due to alleged associate companies among the creditors. As of June, creditors have recovered only about 1% of admitted claims against personal guarantors since FY20. Legal experts note that guarantor insolvency establishes liability but does not guarantee actual recovery. The matter is currently back with the regular bench after an NCLT approval of Chandra’s ₹6.5 crore repayment plan. 💸
